Workers' Compensation Benefits
If you have been injured in your place of work, you are entitled to workers' compensation benefits. These benefits may include medical treatment costs, lost wages, and compensation for the injuries' effect on your ability to work in the future. Hiring a lawyer can help you get the amount you deserve instead of just a minimum payout from insurance companies. That's where Thomas J. Reilly Law Firm P.C. comes in.
Injuries That Prevent Employees From Working
A worker can receive medical treatment for their work related injuries and still not be able to return to work. These injuries are usually very severe, such as blindness or loss of limbs. Injuries like this make it so that the individual will not be able to go work again.
In these cases, there is no limit on the number of weeks of income benefits the worker can receive. The worker could even receive benefits for the rest of their life.
Injuries That Keep Employees From Returning
to Work
An injury can prevent the employee from being able to return to their pre-injury job. In cases like this, the worker can receive weekly benefits at the rate of 2/3 of their weekly wages to a maximum of either 350-400 weeks.
Medical Treatment with Lost Work Time
If you are injured on the job and, while healing, miss time from work you can receive weekly income benefits at the rate of 2/3 your weekly wages. In this case, you will return to work when you have healed. The longer the healing time, the more likely that a worker will be terminated by the pre-injury employer.
Medical Treatment Only
In this case, the worker is injured but it is not serious enough to warrant any time off from work. The worker can continue to work while they are healing.
